A Kelowna man will spend life behind bars for the murder, however, it’s yet to be decided when he could be eligible for parole. Brandon Davina appeared in a Kelowna Supreme Court on Friday, Oct. 2, to be sentenced for the second-degree murder of Brianna Jankauskas.

Crown prosecutor Miho Ogi-Harris told Justice Fitzpatrick that an appropriate sentence is life in prison without parole eligibility for 16 years. Ogi-Harris told the court Davina’s actions were brutal and deliberate, striking Jankauskas upwards of 16 times over the head with an 18-inch crescent wrench, back in August 2023. Crown added that Davina has shown no insight or remorse for his actions, even telling the pre-sentence report writer that Davina does not believe himself to be a violent man.

Other aggravating factors, Crown stated, are a previous conviction of intimate partner violence, the impact Jankauskas’ death has had on her family and friends, and the pre-sentence report writer’s findings that Davina’s likelihood to reoffend is highest in intimate partner relationships. The only mitigating factor as presented by the Crown was that Davina called 911 after the attack and paramedics were dispatched to the scene.

Crown concluded its submissions with victim impact statements read before the court by Jankauskas’ mom, step-dad and sister. All three family members expressed extreme grief for the woman they described as bubbly and with an infectious laugh. Defence lawyer Jordan Watt told the court Davina did have remorse for his actions and was taking steps to better himself while in custody.

Watt told Justice Fitzpatrick his client was taking courses in prison and had completed a course in respectful relationships, however, a certificate to verify completion of the course was not presented. Watt told Fitzpatrick that it was clear the minimum of 10 years before eligibility was too minimal for the nature of the crime, however, he said the Justice should consider the lower end of the scale and ultimately requested no parole eligibility for 12 to 15 years.

Justice Fitzpatrick did not give a decision on sentencing at the conclusion of the defence’s submissions. The matter has been adjourned to November, with a decision expected before the end of the year. On Aug. 20, 2023, after meeting on a dating app, Davina picked up Jankauskas in Vernon and drove him to his Kelowna home at 337 Hardy Road for their first date. Jankauskas decided to stay the night.

The following day, Davina skipped work to spend the day with Jankausas, however, the court heard the victim was texting friends throughout the day, stating Davina was drunk and angry, making her feel unsafe. Justice Fitzpatrick ultimately rejected Davina’s testimony that Jankauskas had provoked the attack and that he’d lost volition due to alcohol consumption.

The court heard that Jankauskas had pushed Davina and called him names, but walked away from the attacker and sat down on the couch with her phone. The victim had no defensive wounds, suggesting she never saw the attack coming. Davina beat the victim over the head with an 18-inch crescent wrench while she sat on his couch. The autopsy revealed Jankauskas had a total of 16 injuries to her head.

Davina called 911 around 9:30 p.m. on Aug. 21, 2023, stating someone was dying on his couch. He fled the scene before police arrived. The arriving officer found Jankauskas bleeding profusely and unresponsive. Paramedics were called to the house, and Jankauskas was transported to the hospital.

She succumbed to her injuries in the early hours of Aug. 22, 2023.
