A Kelowna resident is suing a construction company after his vintage BMW was damaged by a concrete spill during a parkade renovation.
A Kelowna man is seeking $35,050 in damages after his vintage BMW was damaged by concrete during a construction project. Samuel Burghardt filed a notice of civil claim in the provincial small claims court against Stober Construction, alleging that his vehicle was covered in concrete after a pour at the parkade located at 1720 Richter Street. Burghardt states that despite other tenants receiving text alerts to move their vehicles, he was not informed about the concrete pour.
He claims that upon returning to his parked vehicle after the work on July 11th, he discovered his 'fully restored, heavily modified, vintage BMW' covered in concrete. He alleges that construction workers failed to properly fill the holes in the concrete sealing slabs, allowing the concrete to drip onto his car.According to the claim, Burghardt was initially informed by the Stober Construction project manager that the company would cover the cost of repairs. The project manager reportedly acknowledged the extent of the damage to the paint, wheels, and weather seals of Burghardt's 'show-room condition' vehicle. After obtaining an estimate of $30,826 from ICBC to restore his car to its original condition, Burghardt claims that Stober Construction accepted fault and forwarded the issue to their insurance provider. However, Burghardt alleges that over 10 weeks have passed since the appraisal was conducted and he has yet to receive a response or a timeline for the restoration of his vehicle. He is now demanding a total of $35,050 to cover the restoration costs, along with compensation for court fees, his time, and the inconvenience caused by the ongoing situation since July. The owner of the parkade is not named in the claim, and Stober Construction has not yet filed a response. The claims have not been tested in court
