The verdict came in the case of a deputy public defender who said he was forced out after complaining about a racist remark by a supervisor and because of his 'gender expression' as a gay man.

A former county public defender was awarded $2.6 million by a San Diego Superior Court jury this week which found he was wrongly terminated after he complained about a racist comment made by a supervisor, and was discriminated against because of how he presented himself as a gay man.

At the meeting, according to the lawsuit, a Black attorney had told the union board it was alienating the non-White lawyers in the office. The comment prompted Stone, a board member and the assistant supervisor in the Vista office of the agency, to rebuke the lawyer, say he was lazy and accuse him of a “lynching” of the board, said Christopher Ludmer, the lawyer for Davina.

One of the panel members deciding his employment future was Stone, who during the review said “slights against coworkers will come back to you,” according to the lawsuit. At the end of October, his supervisors in the misdemeanor unit told him he had to change his physical appearance, apparently to appease the critics on the review panel. The lawsuit said he ended up cutting his hair, not wearing polish and removing his earring before appearing in court.
