That’s effectively the conclusion of the “Report of the Public Inquiry into the 2022 Public Order Emergency” delivered by Justice Paul Rouleau on Friday. The final report, which was required after the invocation of the Emergencies Act, concluded that the government met the legal threshold required to invoke emergency powers during Freedom Convoy protests — and freeze bank accounts of those suspected to be involved.

Incompetence as an excuse for emergency powers is a terrible precedent to set. In a twisted way, it means that government competence is a liability — if you manage the country poorly enough, you can more easily freeze the bank accounts of your opponents. The report noted that even people who weren’t involved with the convoy faced bank seizures due to holding joint accounts — something that Rouleau called “unjust” but “unavoidable.” He also noted that some people couldn’t buy medicine or pay child support, but he excused this with the quick drafting of the emergency regulations. He noted that the lack of an unfreezing mechanism was a “failure” on the drafters’ part, but the asset-freezing regime overall was “appropriate and effective.

Aside from bank freezes, social media surveillance also got the nod from the commission’s report. The commission recommended that social media surveillance be enhanced.
