Jamie Golombek: Here’s what happened when one taxpayer went to tax court to ask for an extension to file an objection following an audit
By now, most of us have likely filed our 2018 tax return. Tax filing data released by the Canada Revenue Agency on Monday shows that as of this week, the CRA has received just over 18.4 million of the estimated 30 million personal tax returns it expects to receive during the 2019 tax filing season. If you still haven’t filed, you have until April 30 to do so, unless you or your spouse or partner is self-employed, in which case you have until June 17. .
If you disagree with the CRA’s assessment of your return, you can formally object by filing a Notice of Objection . The deadline for filing an objection is one year from the normal filing due date or 90 days after the date printed on the notice of assessment, whichever is later. If you miss the deadline, you can still apply to the CRA within one year of the deadline for an extension of time. If the CRA denies your application, you may appeal to the Tax Court of Canada.
The taxpayer gathered up his documents and mailed them to the CRA, only to have the same envelope and documents returned to him a few weeks later, followed shortly thereafter with a letter from the CRA, and a phone call, in which the auditor explained to him “that he had not categorized his documents properly.” She instructed him to recategorize his documents and to prepare a spreadsheet itemizing the expenses.
That letter also said that if the taxpayer disagreed with the above-noted changes, he could file an objection after he received his notices of reassessment. The CRA reminded him of the deadline, writing: “To file an objection, you have 90 days from the date on your notice of reassessment.”
