ICBC has been ordered to pay $5,000 in damages over a claim that a truck was damaged when vandals poured gas into the diesel fuel tank.

But in a recent decision of the provincial civil resolution tribunal, which handles small claims matters, ICBC’s arguments were dismissed. In her decision, tribunal vice-chairwoman Andrea Ritchie noted that although the insurance claim was not officially opened for three months, Robertson had tried to report it several times and was refused.
While ICBC had obtained a sample of fuel from the repair shop, Ritchie found on balance that it was likely that the sample was taken from the wrong container. She found the best evidence of the cause of the damage was provided by the mechanic who did the repairs and who found that the injector damage was caused by contaminated fuel and, that other than the fuel issue, the truck was in good mechanical repair.
