A Supreme Court jury trial heard from the man accused of killing 26-year-old Yarmouth County resident Colton Cook, but the words came in writing, as opposed to being spoken. A note and a letter were entered into evidence.
Crown attorneys Saara Wilson and Bob Morrison carry boxes of materials into the Yarmouth courtroom, where a homicide trial is underway. TINA COMEAUYARMOUTH, NS – A Supreme Court jury trial heard from the man accused of killing 26-year-old Yarmouth County resident Colton Cook but the words came in writing, as opposed to being spoken.
His son was referring to Rogers and he told his father the person was dead. The father hung up the phone because he did not want to get involved. Both Siscoe Sr. – and his girlfriend Judy Hubbard who also testified on Jan. 12 – said they had found a folded note in their residence the morning after Rogers and others had been at their home playing cards. This was a few days after the death of Cook, which the Crown says happened at a residence at 1338 Highway 340 in South Ohio.
Prosecutor Bob Morrison read excerpts from the letter. “It says, ‘I can remember quite a lot about that night, now that I am not on them pills.” Morrison also read a passage where Rogers refers to passing out when he drinks hard liquor. Siscoe said he has known Rogers for about 15 or 20 years, saying he had first met him a couple of times in jail and that for the past five years they've hung out as friends. Morrison asked Siscoe if he was familiar with Rogers’ handwriting and also asked – given what was being said in the letter – how confident he was that the letter had come from Rogers.
Many of those convictions, however, dated back to the late 1990s. His most recent criminal code conviction was in 2005. The defence also pointed out he does have new charges before the court. "If I suggest that night you told Mr. Rogers to write that note, would you agree with me?" said Brownell.Siscoe was one of five Crown witnesses to testify on Jan. 12. Two of the other witnesses were RCMP officers.
