The House Judiciary Committee is preparing to file a lawsuit to enforce a subpoena for testimony by former White House counsel Don McGahn about efforts to curtail Robert Mueller's investigation

By Rebecca Ballhaus Updated July 24, 2019 5:29 pm ET WASHINGTON—The House Judiciary Committee is preparing to file a lawsuit in the coming days to enforce a subpoena for testimony by former White House counsel Don McGahn, as the panel has so far failed to reach a deal with the White House over a central aspect of his testimony: whether it would be public or private.

With no deal in sight, the committee is preparing to file a lawsuit as early as this week. Rep. Jerrold Nadler , the panel’s chairman, in an interview on Fox on Sunday, said the committee would do so “within a couple of days.” If the committee files a lawsuit against Mr. McGahn, the Justice Department is expected to intervene in the litigation on behalf of the administration. The matter would then be left to the courts to decide.

The committee subpoenaed Mr. McGahn’s testimony after the release of a redacted version of Mr. Mueller’s report on Russian election interference and on Mr. Trump’s efforts to obstruct justice, in which Mr. McGahn’s testimony featured prominently.
