Hedley frontman Jacob Hoggard has been criminally charged with sexually assaulting a third female complainant, a charge that can now be reported by the Star for the first time Tuesday after a jury has begun deliberating whether Hoggard raped a 16-year-old fan and a young woman in 2016.Hoggard, 37, was charged by the Ontario Provincial Police with sexual assault causing bodily harm on March 2, 2022, just two months before his current trial began.

In a shocking moment during the cross-examination of that complainant, the defence itself mistakenly referenced one of these allegations when it showed her a Hoggard’s lawyer Megan Savard had argued that an apology could lead to her client being seen in a negative light. Ultimately, Justice Roberts did rule that the jury could consider whether there is a “specific and distinctive pattern of conduct by Mr. Hoggard that it would defy coincidence that would lie or be mistaken about Mr. Hoggard’s conduct.”

Hoggard is not accused of a crime in relation to the photos, which the complainant testified he first asked for after she turned 16. The Crown argued that this testimony was essential for the jury to understand the context of the complainant’s allegations — as well as for possibly showing similarities in the accounts of the two women.

But when the defence sought to cross-examine the second complainant about specific sexual comments she allegedly made to Hoggard in Snapchat messages leading up to their meeting in a downtown Toronto hotel room to have sex — questions the defence argued were allowed by the ruling — Roberts said her ruling had been a mistake which she regretted.
