London-based gym giant Goodlife Fitness is seeking $70-million in an alleged pandemic-related dispute with its insurer, a statement of claim filed in London court says.

In its statement of claim filed in London court, GoodLife, which has more than 200 locations across Canada, is seeking unspecified general and punitive damages and a court order for “the full amount of business interruption compensation available under the policy.”

The coverage under the insurance policy extended from June 30, 2020 to June 30, 2021, the statement of claim filed in the Superior Court of Justice alleges. Its policy was intended to provide “peace of mind” to Goodlife, which understood the insurance product would provide coverage “if it was forced to close its business due to fortuitous or unforeseen reasons that were beyond its control,” the statement of claim alleges. In an email, Allianz Canada’s head of claims, Bernard McNulty, said the insurer is aware of GoodLife’s action and will take steps to defend itself, declining to comment further.

Businesses in Ontario operated under the spectre of evolving public health restrictions for nearly two years, until after the wave in December 2021 and January 2022 fueled by the highly transmissible Omicron variant of the virus.
