The Tsetsaut Skii km Lax Ha Nation's legal representative, Ryan Beaton, claims that the tailings waste from the KSM Mine Project will be located in the nation's territory, and that the government has moved forward with approving the mine without addressing the nation's concerns. He argues that the province has not fulfilled its legal obligation to engage with the nation regarding its concerns. Beaton points out that the province has only engaged with the larger Tahltan and Nisga'a nations, ignoring the concerns of the Tsetsaut Skii km Lax Ha Nation. Seabridge Gold acknowledges that they do not have access to the record of consultation between the province and the nation and cannot comment on the validity of the nation's claims. The company has invested $444 million in work related to its environmental assessment certificate and has received support from representatives of the three major Indigenous groups in the area
