“It is unfortunate that months after this tragedy, DPD has avoided holding themselves and their officers accountable for what happened to Kyle,” Moore said in a written statement Tuesday. “This civil rights lawsuit is an attempt made by Kyle’s family to find the justice that the City of Dallas and Dallas County have avoided aiding in retrieving, even though it is what the Dail family is owed.”

Before the struggle with officers, police spotted Dail about 10:20 p.m. in the gas station’s parking lot, where they said he made the drug sales and then drove off. Officers followed him but called off the operation when Dail didn’t stop for them and they lost sight of his car. “Don’t move,” and Dail yelled “I’m not moving” at least eight times as Hoffman, Hemm and Piering pushed him onto a counter and struggled to reach Dail’s hands. Dail yelled “I can’t see” multiple times.

Dail’s head was rammed into a soft-drink dispenser and officers sprayed him with mace, the lawsuit says, adding that Dail was unarmed and blinded when he was shot.also voiced concerns after Dail’s death about how the officers approached Dail and whether use-of-force policies were followed.
