Erin Townley, one of the cyclists who was hit by the Nissan and suffered serious injuries, told the court that she remembered the sound of the car’s impact, and then everything went black. When she woke up, she was holding her fractured right arm. According to the driver, he had not seen the cyclists on the side of the road before the collision. If he had, he said he would have driven into the guardrail to avoid hitting them.
“This split-second emergency event was entirely of his own creation,” wrote Beaudoin in his June decision.
