Defence lawyer and federal prosecutor jointly recommended accused be sentenced to two and a half years custody for the drug offences
Dylan Marshall was a suspended driver behind the wheel of a vehicle with two different licence plates when city police officers stopped him on a downtown street on a summer day two years ago.
Marshall pleaded guilty to possession of fentanyl for the purpose of trafficking, possession of methamphetamine for the purpose of trafficking and breach of probation. They also discovered a digital scale, a plastic bag with seven grams of meth, more fentanyl and $690 in cash in the vehicle.At the time of Marshall's arrest, the value of the drugs was estimated at a high of $12,000 to a low of $2,700.
Assistant Crown attorney Matthew Caputo called for the minimum $1,000 fine for POA offence of getting behind the wheel while suspended.The provincial prosecutor also urged Kwolek to impose the mandatory minimum monetary penalty of $5,000 for the insurance offence.His client has been in custody since July 2021, has no income and the fines would be setting him up for failure.
During his time in custody, he has been involved in programming at the Algoma Treatment and Remand Centre, Orazietti said.
