In an appeal heard now by two courts, 24-year-old Hunter argued that the verdicts from the jury were “so contrary to the weight of the evidence that it shocks one’s sense of justice.” Police narrowed in on Hunter when surveillance footage showed him trying to break into cars nearby. A witness who was walking his dog in the area around the time of the assault also saw Hunter, providing clear physical and clothing descriptions to police that he was later able to affirm through a photo lineup, according to the trial court’s decision.

The courts found that not only was he well aware of his rights to not talk during the interview, but that there was no indication to the detectives that he was under the influence at the time., including Hunter describing Esworthy dropping to the ground after he was hit. The trial court pointed to Hunter’s admission that he had been smoking synthetic marijuana for several years before the murder and likely built up a tolerance. The court felt this meant the effects of the drug would have worn off by the time he did the police interview.

The final piece of evidence Hunter tried to counter in the appeal was the witness statement that showed him in the area at the time of the robbery.
