Dallas, Texas, developer discusses park officials' eminent-domain vote on Fairfield Lake State Park property in Freestone County.
that’s surrounded the land purchase, causing an outcry from some Texans to budget money to create and protect more public land and outrage others up in arms about how the state should respect and defend private property rights.
“I’ve been in more than one rodeo regarding condemnation and I can assure you right now that these commissioners are just throwing out the word eminent domain but they don’t have the money appropriated for eminent domain,” Todd said. “They have money appropriate to them for willing sellers just like they placed in their offer to Vistra.”“If the state goes to that place, we’ll be legally prepared for battle,” he said.
The land was listed for more than $110 million in 2021, three years after Vistra first notified the state it was going to end the lease and sell the land, according to officials.. They have another 30 days from this past weekend’s vote to send a final written offer based off an appraisal on the land. Although the state hasn’t shared an estimate, Todd Interests previously told The Dallas Morning News it would be in the hundreds of millions especially because of the lake water.
Todd Interests will have 14 days to respond to the appraisal-based offer. If he agrees, the months-long drama will near an end. If he declines, the issue heads to court and the Attorney General’s Office will file a petition to condemn the land.
