Democrats are introducing the Equality Act, which amends the Civil Rights Act to prohibit discrimination on the basis of sexual orientation & gender identity in education, employment, housing, public accommodations and the use of federal funds
ALBANY — Top New York lawmakers agree that the state should take action on the Equal Rights Amendment this year. But what exactly that means remains unclear, because there are several drastically different versions of the decades-long proposal floating around.
While that proposal has gained some traction since Democrats won control of Krueger’s chamber last year, there’s a much older version of the state ERA that’s still kicking around. A version that would simply add “sex” to the list of protected categories passed the Assembly last year and in February. "It is unacceptable that more than 100 years after women won the right to vote in New York State, our Constitution still does not ban discrimination based on sex or afford women equal protections under the law,” he said in a statement honoring International Women’s Day just last Friday. “That needs to end this year.”
Some Democrats have described the narrower bill almost as a failsafe should the broader one run into any issues. It certainly makes sense that supporters would want to be careful with that version and make sure that its adoption doesn’t result in any unintended consequences. It would delete the entire equal protection clause from the state constitution and insert a new 200-word section.
