A San Diego federal judge has ruled against a North County woman who claimed she was given a Caesarean-section without anesthesia at an Oceanside hospital four years ago.Tri-City Medical Center, the surgeon and the anesthesiologist involved in the birth, alleging that Mota was given a C-section without general anesthesia when Mota’s labor turned into an emergency.

Because Lopez works for the federally funded Vista Community Clinic, the U.S. Attorney’s Office represented the federal government as a defendant in the case. According to the suit, Mota was more than 41 weeks pregnant when she was admitted to Tri-City Medical Center on Nov. 15, 2017 to have her labor induced. Early Nov. 16, medical workers could not read the fetal heart rate. Mota was taken to the operating room for an emergency C-section.

The judge said Mota’s account of what happened in the operating room was “not credible,” and that she was “clearly under stress.” He noted that none of the medical staffers in the room said they heard her screaming. Icheanor has said he could hear her screams in the hospital corridor. He pointed to testimony and evidence that Mota was not under general anesthesia “but had a continuous fentanyl drip” and local anesthesia.
