Former lawyer for convicted child killer Justin Bennett says he lied in an affidavit to support his bid for a mistrial in the case.

New counsel wants mistrial declared

Lazin wants Justice Blair Nixon to declare a mistrial in the case, arguing his client wasn’t adequately represented by Fay, a well-respected, long-time criminal lawyer in Calgary. Bennett has spent the last five years housed at the Calgary Remand Centre, half of which has lapsed since Nixon found him guilty of second-degree murder in the 2017 death of three-year-old Ivy, the daughter of his then-girlfriend, Helen Wordsworth.Fay vehemently denied telling Bennett not to mention he was gaming with Greco, a resident of South Carolina, when he heard Ivy scream inside the apartment he shared with Wordsworth.

The child was hospitalized with a severe brain injury on Sept. 27, 2017, and died just over a week later. Ivy Wick, 3, died on Oct. 5, 2017, about a week after she was beaten by her stepfather Justin Bennett.Lazin suggested Bennett was about to testify about gaming with Greco when Fay interrupted to say he wasn’t.“It strikes at the very heart of my status as a long-time defence counsel in this community. To suggest that I would suggest to my client or a witness to lie on the witness stand is an unblemished, blatant lie.”“Mr. Bennett has a long and documented history of being a liar,” Fay responded.
