ST. JACOBS, ONT. — Steed and Evans Ltd., a civil infrastructure and material supply company based in St. Jacobs, Ontario, has been penalized following a construction incident where a worker sustained critical injuries. According to an Ontario government court bulletin, on June 10, 2022, a worker was parging previously installed sewer chambers in the middle of a roadway on Elliott Avenue and Harpin Way in Fergus.

This involved reaching into the sewer chamber and applying a coat of mixed cement to the inside collar to fill in gaps and cracks. While performing this task on the ground beside the chamber, another worker driving through the area struck the first worker, resulting in critical injuries. At the time of the incident, the worker on the ground was wearing a high visibility vest and working alone. Notably, there were no traffic control measures in place around the worker, nor any barriers or warning signs to delineate the workspace.The bulletin further states that while the road where the work was taking place was unassumed and not open to public traffic, it remained accessible to vehicular traffic, frequently used for construction vehicles and equipment. A subsequent investigation by the Ministry of Labour, Immigration, Training and Skills Development concluded that Steed and Evans Ltd. failed to implement adequate warning signs or barriers to safeguard the worker performing tasks on the roadway. The company also fell short of ensuring measures and procedures prescribed by the Occupational Health and Safety Act. Following a guilty plea in the Provincial Offences Court in Guelph, Steed and Evans Ltd. was fined $70,000 by Justice of the Peace Michael Cuthbertson. The conviction was recorded on November 15, 2024.
