It is in any case impossible to be certain of another person’s motivation, even if the ostensible motivation is declared. Unless the person doing the hiring specifically states to disappointed candidates that they’re not being engaged because the person doing the hiring disapproves of their pigmentation, ethnicity, sex, sexuality or some other absurd and discriminatory factor, there is no possible way of knowing if a candidate was discriminated against.
The law society is tasked with regulating the legal profession; neither it nor any other authority has any standing to micro-manage the lives of its professionals in other areas. It is distressing that the self-regulatory apparatus of Ontario’s legal profession would take unto itself and attempt to inflict upon all lawyers in the jurisdiction the heavy yoke of an obligation of aggressive proselytization of affirmative action in all aspects of their lives.
