The 60-year-old complainant testified that after leaving the hospital Const. Ryan Dougherty ‘assaulted’ him by punching him in the face, but the defence says that is inconsistent with the evidence.
THUNDER BAY – The 60-year-old man who was detained under the Mental Health Act said after leaving the hospital he was ‘assaulted’ by Const. Ryan Dougherty of the Thunder Bay Police Service, but the defence argues the evidence is not consistent with his recounting of events.
Based on the complainant’s behaviour and concern for his well-being, officers decided to transport him to the Thunder Bay Regional Health Sciences Centre under the Mental Health Act. “ got out of the car and told me to raise my hands, which I did,” the complainant testified. “And then he told me put my hands on the hood of his car. I was about to do that and that’s when the interaction occurred.”
During cross-examination by defence counsel Michael Hargadon, the complainant was asked if he was agitated at the time of his interaction with Dougherty.“No, I don’t remember,” the complainant said.
