A class-action lawsuit has been certified against the Calgary Board of Education and two former teachers accused of abusing students at John Ware Junior High School.
A class-action lawsuit alleging abuse by two former teachers at John Ware Junior High School in Calgary has been certified in the Alberta courts. The lawsuit, approved by Justice Hollins of the Court of King's Bench of Alberta, claims that the Calgary Board of Education (CBE) and the estates of former teachers Michael Gregory and Fred Archer failed to adequately respond to reports of abuse made by students.
The lawsuit outlines three subclasses of plaintiffs: those who allege sexual assault by Gregory, those who allege physical assault by Gregory, and those who allege both sexual and physical assault by Archer. Justice Hollins approved the class-action suit after reviewing a mass tort action proposal, finding that individual cases would be difficult for the now-adult alleged victims to pursue. She acknowledged the distinct nature of the allegations against each teacher, recognizing the differences in their tenure and alleged abusive behaviors. Gregory is accused of sexually abusing female students and physically abusing male students in various locations, including at school, his rural property, and during unofficial 'scouting trips.' Archer is accused of sexually and physically abusing male students at John Ware School during the 1990s. He has previously pleaded guilty to sexually abusing students at another school. The lawsuit alleges that the CBE is vicariously liable for the actions of its employees, and directly liable for creating an environment that allowed abuse to occur. It claims the CBE failed to investigate the teachers and enforce policies to prevent sexual abuse despite being aware of the occurrences. The CBE, in a statement to CBC News, stated that it is reviewing the decision and taking the allegations seriously but is unable to comment further as the matter is before the courts. The CBE emphasized its commitment to creating a safe and welcoming learning environment for all students
