The parents least able to defend themselves, those already most targeted by law\u002Denforcement and child services, will bear the brunt of this.
Essentially an exception to the Criminal Code’s provisions against assault and forcible confinement, Section 43 reads as follows: “Every schoolteacher, parent or person standing in the place of a parent is justified in using force by way of correction toward a pupil or child, as the case may be, who is under his care, if the force does not exceed what is reasonable under the circumstances.
So then, why mess with it? Well, here’s one terrible reason: A teacher interviewed by the Globe suggested that a colleague might happen across Section 43 while browsing the Criminal Code — as one does — and start waving his fists about. “My students were … surprised to see what they could be on the receiving end of,” this teacher said, which seems like a weird thing to say.
