“Our client is still traumatized by the assault. They look forward to getting past this incident and return to work with the many colleagues who welcomed them and treated them respectfully,” the lawyer said. The non-binary firefighter asked their captain if they could leave work to go to the hospital after the reported choking, but says they were told they had to finish their shift, according to police.In a statement on the firefighter’s behalf, defence lawyer Dominic Lamb said, “Personally and professionally, Eric supports and embraces a diverse workplace that reflects our community.Article content
A live issue if the case reaches trial will be if the Crown can prove bodily harm beyond a reasonable doubt. If the case gets to trial, medical reports — including photos taken after the alleged assault — will be examined in court.
