Charges laid against Const. Kevin Benloss a year ago were formally withdrawn by the Crown Attorney’s office this week.

Benloss was suspended with pay in September 2020 following an unrelated disciplinary complaint, which included allegations of discreditable conduct and insubordination under the Police Services Act.

He was acquitted in November on those charges, but remained under suspension pending the outcome of his criminal case.The discreditable conduct charge stemmed from an incident in March 2011, when it was alleged that Benloss “engaged in communication and/or physical and/or sexual contact towards a sworn member … that you ought to have known was unwelcome, unwanted, offensive, intimidating, hostile or inappropriate.

Benloss was found not guilty in November, with hearing officer Greg Walton noting in his decision that “the evidence has failed to convince me that the allegations must be true… “To find Const. Benloss guilty of the alleged misconduct, the evidence must be so clear, so reliable, and so convincing, as to persuade me the alleges are true and the facts in issue satisfied,” wrote Walton, a retired Ontario Provincial Police superintendent.He was demoted in 2017 for admitting he fabricated traffic warnings issued to drivers in the police database during an investigation into “ghost warnings” by Ottawa police officers.

He pleaded guilty to two counts of discreditable conduct and one count of insubordination under the Police Services Act and was sentenced to a temporary demotion from first- to second-class constable.Ottawa Police Association president Matthew Cox said Tuesday that his organization “will wait to see if a Professional Standards Investigation will follow, which is common after criminal charges are concluded.
