The Community Assistance, Recovery and Empowerment Court, or CARE Court, has been heralded as a way to expand the number of people who could be mandated treatment for mental health disorders.
In 2022, California launched an effort to address one of the state’s most frustrating issues: How to get mental health care to people who may not want it.
Under the CARE Act, which legislators approved last year, courts could mandate people undergo up to 24 months of treatment that would be community-based and individualized. Treatment could include short-term stabilization medications and connection to housing and other support services. Under the new approach, family members, first responders, clinicians and community members could refer a person to CARE Court to be evaluated for eligibility to a treatment program. To be eligible, a person must be either unlikely to survive safely without supervision or be a threat to themselves or others.
