Seven years after two Muslim teens were banned from making their daily prayers at a private non-denominational high school in Calgary, the Alberta Human Rights Commission must decide whether to restart their discrimination case, now that the Supreme Court of Canada has declined to hear an appeal.
“At this time, a decision has not been made on how the Commission will proceed with this matter,” said spokesman Cam Stewart. In 2015, a tribunal found the school discriminated on the grounds of religious belief in a service customarily available to the public. It found the school offered the boys’s parents a “generally positive indication of acceptance” of prayers, and even pointed out a space in the library. Two weeks after the boys started attending classes in December, 2011, however, Webber called the parents to say prayer was not allowed.
The tribunal found the school wrongly characterized the dispute as a request for prayer space, as in a whole dedicated room. “The amount of space required for the Muslim prayer as described here is only slightly larger than the space occupied by a person,” the tribunal decided. But the Court of Appeal of Alberta overturned the original decision, ordered a new tribunal, and pointed out the tribunal’s “muddled” thinking on the question of “prayer space.”
