A B.C. man is appealing his assault sentence because the trial judge ignored Indigenous heritage
In that case, which the Court of Appeal ruled on in January, the three appeal judges found, “Disconnection is one of the very harms associated with Canada’s colonial history and assimilationist policies that Gladue seeks to address.”
Kehoe’s “moral blameworthiness was significantly reduced” and the Criminal Code and Gladue principles “had an important role to play in sentencing him,” the appeal court said. Groberman said Kehoe’s assault was serious — he stabbed a man because he and his friends were playing music outside his Chilliwack apartment and the victim would have died without surgery — and Kehoe, 30, had 33 prior convictions, including breaches of court orders and parole violations.Article content
