Defence lawyer Jessie McNeil objected when prosecutor Jeff Summers attempted to submit the photo as evidence, saying her client had not seen it. The Crown hadn’t provided the image in a disclosure packet before trial and McNeil had only been able to view it herself at Royal Newfoundland Constabulary headquarters in the presence of the lead investigator on the case, she said.“Even if I did bring my client, we were supposed to sit down for however long and review our case in front of Const.

Summers argued there was no evidence before the court that the accused hadn’t seen the image, and presented an email he had sent to McNeil, mentioning her option to challenge the disclosure access. Summers spoke of Marshall’s statements about him “concocting” an arbitrary disclosure access procedure, referring to him as obstructive, accepting facts not presented in evidence, and denying a hearing.
