Linhardt in his opinion cited the Department of State’s “keen interest” in the litigation because it had the potential to affect how requests for these records are handled throughout the commonwealth. There is a column for each candidate that was on the ballot and nearly 60,000 rows representing everyone who voted in 2020, he said. A viewer could see for which offices a vote was cast but not who cast it, he said.

The judge in his December opinion acknowledged free and fair elections are the bedrock of the country’s democracy; the importance of public confidence in them cannot be overstated.The Legislature intended the “contents” of ballot boxes or voting machines to refer deposited ballots and the mechanical inner working of the machines not the information contained from them.
