CHARLOTTETOWN, P.E.I. — An American traveller who slipped and fell down a staircase while trying to board an airplane at the Charlottetown airport is suing Air Canada for damages.According to a statement of claim filed on July 4 in P.E.I. Supreme Court, the plaintiff, Lily Ann Freid, arrived at the Charlottetown airport on Nov. 2, 2015, at around 4 a.m. for a scheduled flight to Montreal and then New York. Freid is a resident of Parsippany, N.J.
Freid claims that her injuries were caused by Air Canada's negligence and that she is entitled to damages. In particular, Freid says that Air Canada failed to have agents at the top and/or at the bottom of the staircase to help her get on the airplane. In addition, she claims that Air Canada didn't have agents on the ground outside the airplane to help her at the gate with checking her carry-on baggage.
The statement of claim contains allegations not tested or proven in court. The statement of claim also does not specify an amount being sought in damages. On Sept. 13, Air Canada filed a statement of defence with the court and denied the allegations, including any negligence or breach of duty by its agents or employees.
