Kings County council considered second and final reading of the text amendment following a public hearing on April 4. The change was approved with one councillor, Deputy Mayor Emily Lutz, voting against it.Area councillor Peter Allen did not participate in the council discussion and did not vote, having earlier declared a conflict of interest. Allen said he and Patricia Warren currently own the subject property.

Municipal staff’s position is that farm supportive use should have been included on the list of permitted uses for the A5 zone when it was adopted in 2019. “I feel as a planner, as a resident, that I have to speak up,” Blanchard said. “This has to be managed better. This should be done in a site-specific way.”

Blanchard indicated in her presentation that if council were to approve the broad text amendment, the decision would likely be appealed to the UARB. Following the meeting, she said she intends to do so. Blanchard said she doesn’t believe it was an oversight when a mechanism for development agreements wasn’t included when the A5 zone was established. She said this was done deliberately.
