“The employees never had the requisite illness or injury which was a precondition for sick leave,” the arbitrator concluded, and said the firefighters were entitled to use those days as special leave. Two of the firefighters applied to the Workplace Safety Insurance Board, but their benefit claims were denied on the basis they “had not experienced any symptoms, illness, or disease resulting from an exposure to a harmful chemical or substance in the workplace” during the close contact on Dec. 9, 2021.
