“By refusing to obey the command to reapply his mask, he did not comply with a crew member’s instruction. I accept that this was an instruction regarding the safety of those aboard the aircraft.”Sailer was charged in connection with a July 20, 2021, incident in which he removed his mask about 40 minutes before his flight from Toronto landed in Calgary.
He told Robertson his anxiety was heightened by an earlier incident on the flight when a passenger in the row behind him suffered an epileptic seizure, which resulted in multiple crew members attending to the emergency.Article content “Mr. Sailer’s thought process when he took his mask off was that he was in a desperate situation,” Robertson said.
