Judge pointed to victim's age, vulnerability, the effect of the crimes on her, the number of sexual assaults and the frequency of them
A middle-aged man has been sentenced to four years in a federal penitentiary for sexually assaulting a teenaged girl.He found the 60-year-old accused guilty of the charge on April 11 of this year, following a trial that took place in December 2021.
In his decision, released July 15, Varpio noted the Crown and defence agreed the sentence for sexual assaults of this kind range between three and six years. When he imposed the prison term, Varpio said deterrence and denunciation must play a primary role to send the appropriate message to both the offender and the community that his conduct is unacceptable and will have meaningful consequences.
The man's mental health issues play a role in the sentencing but there is no suggestion they contributed to the crime, he said.
